Welcome to WhisperTyping. By downloading, installing, or using WhisperTyping software ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using WhisperTyping, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
WhisperTyping is a voice dictation software application for Windows that converts speech to text using cloud-based speech recognition. The Service may include:
- Voice-to-text transcription
- AI-powered text enhancement features
- Virtual keyboard functionality
- Voice command execution
3. Account Registration
To use certain features of the Service, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any information that becomes inaccurate
- Accept responsibility for all activities under your account
4. Free Trial and Subscriptions
4.1 Free Trial
WhisperTyping offers a free tier with limited transcription minutes per 30-day rolling period. No payment information is required to use the free tier.
4.2 Paid Subscriptions
Paid subscriptions provide additional features and unlimited transcription. By subscribing, you agree to:
- Pay all applicable fees as described at the time of purchase
- Automatic renewal at the end of each billing period unless cancelled
- Provide valid payment information and keep it current
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods, except where required by applicable law.
4.4 Changes to Subscription Features
The features, capabilities, and technical specifications of the Service may change over time. Technology evolves, cloud providers and AI models may become unavailable, and we may need to adapt the Service accordingly. By subscribing, you acknowledge and agree that:
- We may modify, update, or replace the underlying technology, including speech recognition models, AI providers, and cloud infrastructure
- Specific features or capabilities may be added, modified, or discontinued
- We will endeavor to apply upgrades and improvements to your subscription tier, never downgrades
- Service availability is subject to the availability of our third-party providers and cloud capacity
- We will provide reasonable notice of material changes where practicable
Our goal is to continuously improve the Service, and we strive to ensure that any changes maintain or enhance the value you receive from your subscription.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service
- Use the Service for competitive analysis or to build competing products
- Resell, redistribute, or sublicense the Service without authorization
- Circumvent usage limits or billing mechanisms
6. Intellectual Property
6.1 Our Rights
WhisperTyping and its licensors own all rights, title, and interest in the Service, including all intellectual property rights. These Terms do not grant you any rights to our trademarks, service marks, or logos.
6.2 Your Content
You retain ownership of any content you create using the Service. Your transcriptions and dictated text remain your property. We do not claim any ownership of your content.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Key points include:
- We do not store your audio recordings or transcripts on our servers
- Audio is processed transiently and erased after transcription
- Your dictation history remains on your local computer
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Accuracy of transcriptions or AI-generated content
- Uninterrupted or error-free operation
- Freedom from viruses or harmful components
You acknowledge that speech recognition technology is not perfect and may produce errors. You are responsible for reviewing and correcting transcriptions before use.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPERTYPING AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, business opportunities, or goodwill
- Any damages arising from your use or inability to use the Service
Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless WhisperTyping and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of third parties
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the Service immediately ceases
- We may delete your account and associated data
- Sections of these Terms that should survive termination will remain in effect
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Australia.
13. General Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and WhisperTyping regarding the Service.
13.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
